This Privacy & Cookie Policy explains how Motohaus Powersports Limited collects, uses, shares and protects personal information when you use our trade ordering website at https://www.motohaus-b2b.com (the "Services"). Our trade store is intended for business customers, but data protection law protects individuals, so this policy explains how we handle the personal information of the individuals who deal with us on behalf of our trade customers (for example contacts, buyers and account administrators).

Motohaus Powersports Limited is the controller of this personal information. This policy should be read together with our Terms of Service.

1. Who we are

We are the controller of your personal information for the purposes of the UK GDPR, the Data Protection Act 2018 and, where it applies, the EU GDPR.

2. The personal information we collect

We do not intentionally collect special category data through the Services.

3. Where we collect it from

We collect personal information directly from you and your colleagues; automatically through cookies and similar technologies (see section 7); from our service providers and partners; and, where relevant to trade accounts and credit, from credit reference and fraud-prevention agencies and other business sources.

4. How and why we use your information

  • To operate our trading relationship and perform our contract – setting up and managing trade accounts, processing and fulfilling orders, invoicing, managing credit terms and providing support. Lawful basis: performance of a contract; legitimate interests.
  • To communicate with you, including through AI-assisted tools (see section 6). Lawful basis: performance of a contract; legitimate interests.
  • For account management and B2B marketing – telling you about products, pricing and offers relevant to your trade account. Lawful basis: legitimate interests; consent where required.
  • For credit assessment, security and fraud prevention – carrying out account and credit checks and detecting and preventing fraud. Lawful basis: legitimate interests; legal obligation.
  • For analytics and improvement of the Services. Lawful basis: consent (for non-essential cookies); legitimate interests.
  • For legal and compliance reasons. Lawful basis: legal obligation; legitimate interests.

5. Monitoring and recording of communications

We may monitor and record communications, including live chat, email and telephone calls, for quality assurance, training, security, compliance and to improve our products, services and systems (including AI-assisted systems). We will tell you at the point of contact.

6. Artificial intelligence and automated interactions

We use AI-assisted tools to support customer service and the trade experience, including an AI-powered live chat / support assistant.

  • You will always be told when you are interacting with an AI system, consistent with the transparency obligations under Article 50 of the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), which apply from 2 August 2026, and with UK law.
  • You can always reach a human by emailing sales@motohaus.com or telephoning us.
  • Chat content may be processed and recorded as described in section 5 and used to operate, monitor and improve our AI-assisted systems, on the basis of our legitimate interests or your consent.
  • We do not make decisions producing legal or similarly significant effects based solely on automated processing without meaningful human involvement. Where any such decision is made, you have the rights in section 11.

7. Cookies and similar technologies

We use cookies and similar technologies and a consent management tool that lets you accept or reject non-essential cookies and change your choices at any time. We do not set non-essential cookies before you consent. We group cookies into four categories; retention periods are typical ranges and some browser-managed cookies may persist longer.

8. How we share your information

We do not sell your personal information. We share it with our service providers (processors) under written contracts (see section 10); with advertising and marketing partners where you have consented to the relevant cookies; where you direct or consent; with our group, advisers and in connection with a business transaction; with credit reference and fraud-prevention agencies; and for legal reasons.

9. Marketing

We will send B2B marketing in line with the Privacy and Electronic Communications Regulations and the UK GDPR, relying on consent where required or on the soft opt-in. You can opt out at any time using the unsubscribe link or by contacting sales@motohaus.com. Opting out will not stop service messages about your account or orders.

10. Service providers and data-processing contracts

Where a service provider processes personal information on our behalf, it does so as our processor and we remain the controller. We only engage processors that provide sufficient guarantees to meet Article 28 of the UK GDPR, under a written contract requiring the processor to:

  • process the personal information only on our documented instructions;
  • ensure persons authorised to process it are under a duty of confidentiality;
  • implement appropriate technical and organisational security measures (Article 32 UK GDPR);
  • not engage a sub-processor without our authorisation and equivalent protections;
  • assist us in responding to individuals exercising their rights;
  • assist us with security, breach notification and data protection impact assessments;
  • delete or return the personal information at the end of the services; and
  • make available the information needed to demonstrate compliance and allow audits.

Our principal service providers include Shopify (e-commerce platform), our payment providers (including Shop Pay/Shopify Payments and PayPal), Klaviyo (email and marketing), Google, Meta, Microsoft, Hotjar, AdRoll, our AI-assisted customer-support provider, our carriers and fulfilment partners, and our credit reference and fraud-prevention providers. 11. International transfers

Some service providers are located outside the United Kingdom, including in the United States. Where we transfer personal information outside the UK (or, where the EU GDPR applies, outside the EEA), we use a lawful transfer mechanism:

  • Adequacy for transfers to the EEA and other countries covered by UK adequacy regulations;
  • the UK-US data bridge where the US recipient has certified its commitment to comply with the UK Extension to the EU-US Data Privacy Framework and appears on the Data Privacy Framework List; or
  • the International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses for other restricted transfers, supported by a transfer risk assessment and any additional measures identified.

12. How long we keep your information

We keep personal information only for as long as we need it for the purposes in this policy, including to provide the Services and comply with our legal, accounting and tax obligations, resolve disputes and enforce our agreements. We then securely delete or anonymise it.

13. How we protect your information

We maintain appropriate physical, technical and organisational measures, including encryption of information in transit. No security measures are completely secure. Please keep your account credentials confidential.

14. Your rights

Subject to conditions and exceptions, you have the right to access, rectify, erase, restrict and object to processing, to data portability, and to withdraw consent where we rely on it. You also have rights in relation to solely automated decision-making (see section 6). To exercise any right, contact sales@motohaus.com. We will respond within one month (extendable for complex requests). We may need to verify your identity.

15. Complaints

Please contact us first at sales@motohaus.com. We operate a data protection complaints procedure: we will acknowledge your complaint within 30 days, investigate and respond without undue delay, and tell you the outcome. You may also complain to the Information Commissioner's Office (www.ico.org.uk) at any time, or to your local supervisory authority if you are in the EEA.

16. Changes to this policy

We may update this policy from time to time. We will post the updated version on the Website and change the "Last updated" date. We will give more prominent notice of material changes.
